One of the main areas of contention arises where a jointly owned property is involved. There is often a dispute between the parties as to whether the property should be sold and if so, how the proceeds of sale should be divided.
At Bates nvh we are experienced in advising clients as to their legal position and in assisting in reaching an agreement. In some cases, matters can be resolved by way of correspondence between solicitors. However, in other cases it may be necessary to make an application to the Court under the Trusts of Land and Appointment of Trustees Act 1996.
In all cases, we will attempt to resolve matters by way of negotiation and correspondence in the first instance, before resorting to the more formal Court proceedings.
We can also assist in drawing up a Separation Agreement which defines the agreement reached between both parties upon separation.
